In the wordwide,the threat of AIDS,influenza,and the recent outbreak of a very wide range of avain influenza H7N9.A11these are life-threatening for human health.Also these are important to public heaith problem.The key issue is to slove the contradicition pharmaceutical patent protection and high drug prices between two Chancery, on the one hand to be able to have enough incentives to promote the overall development of the pharmaceutical industry, on the other hand also makes it possible to obtain a reasonable effective and affordable medicines.And medicine patent compulsory licensing system is the best interests of all parties into account good system.This thesis is composed of introdction,body and conliusion.Introduction represents the singificance and the purpose of this study and research questions.The text was divided into four chapters. The first chapter, compulsory licensing of pharmaceutical patents preliminary definitions and values from the analysis of the legal and institutional drug patent compulsory licensing system.The second chapter, Through a series of international treaties background as Paris Convention,TRIPS.We can see that the international lineage, and international conventions has been the compulsory licensing regime for pharmaceuticals in improving access to medicines to protect public health issues and the role of public heaith problem.The Third chapter, through introduced to the United States, the European Union, represented by the developed countries and in India, Brazil and developing countries represented on their drug patents compulsory licensing provisions and practices.The forth chapter, discusses the perfect drug patent compulsory licensing system for China’s revelation,Start with the status quo introduce legislation related to domestic conditions and practice to start, and then put forward a sound system of compulsory licensing of drug patents conceived in several ways.The conclusion, I believe that research on drug patent compulsory licensing system under the current situation in China and the global epidemic of this background is very necessary research and discussion,Both to enhance access to medicines, makes it possible to obtain a reasonable price effective and affordable medicines, safeguard public health; but also to improve health systems and infrastructure of a country radically improve a country’s pharmaceutical industry fundamentally R&D level, benefiting from a fundamentally nationals and to promote public health worldwide to contribute.
