The Study On The Protection Of Rights And Interests Of Floating Populations Of Urban Ethnic Minorities

Since the reform and opening up began, with the rapid development of economy and the speeding up of urbanization, the barriers between urban and rural areas have been broken and the population has begun to flow freely. Today, a large number of floating population has formed a huge team.Among them, the Floating PoPulations of urban ethnic minorities become a unique and important component because of its own cultural background. Minority population has enriched the culture of its city and contributed their strength for the economy of the place where they flow into, injected new vitality in the process of flowing. However, due to some incomplete laws and regulations, and the differences between ethnic minorities and the urban residents in cultural traditions, religious beliefs, customs, lifestyle, values and so on, it often occurs that the legitimate rights and interests of ethnic floating population are violated. If the situation does not change, the minority floating population will have resentment and malice to urban, which is not conducive to the development of the sensitive and complex ethnic relations. Therefore, to protect the legitimate rights and interests of Floating PoPulations of urban ethnic minorities is the urgent requirement of their current living state.It is also a need to develope urban stability and an urgent topic of national work. At the same time, it is of great significance to maintain social stability, strengthen national unity and construct a harmonious socialist society.Floating populations of urban ethnic minorities is researched by sociology, economics, urban science, demographic and other traditional subjects as an important problem and it is also an important issue focused on by national law which is an emerging discipline. City is the main intersection of different ethnic groups and cultures, so it is the main area that national relations problems occur. According to the actual situation of the increasing rights and interests problems of the minority floating population in cities,take foreign ethnic floating population in Guilin as an example in recent years, the paper is going to discuss preliminarily the rights and interests problems of floating populations of urban ethnic minorities in our country.Guilin,as an international tourist city, the third largest city of the Guangxi Zhuang Autonomous Region, has attracted a large number of ethnic floating population to migrant workers in business and it conforms to the requirements of inspecting. In protecting the lawful rights and interests of the ethnic floating population,Guilin has made great achievements.However,because of the language, custom and religious beliefs vary with the han nationality in many respects,under the comprehensive effect of various factors, some friction and damage events often happen, thus form part of "blind spots" of the ethnic floating population’s rights and interests protection. Because Guilin has the many characteristics of problems to protect ethnic floating population’s rights and interests, it is selected as a case to argue and research.On the methods, the relevant theories of jurisprudence, ethnology and anthropology are used in this article. Based on empirical research, through methods of literature research, case study and theory with practice, the writer is going to summarize the basic situation in education and employment of urban minority floating population and analyze its characteristic. The current relevant policies and regulations will be combed which urban uses to manage minority floating population.Take the current reality problem faced by ethnic floating population as the breakthrough point, through the analysis of the present situation of rights and interests protection of our urban minority floating population,the writer points out the existing problems,then research the subjective and objective reasons that influence the rights and interests protection of ethnic floating population,and puts forward some countermeasures and suggestions to solve these problems. By putting forward suggestions to guarantee the legitimate rights and interests of minority floating population, under the principles of theory serving for reality and theory guiding to reality, the writer hopes to provide some ideas for a broader and deeper research in reality problems for minority law.The paper is divided into five parts:The first part:introduction, briefly discussion on the research significance, research present situation of articles reviews, method and thought of the paper and possible innovation.The second part:summary of the rights and interests of the urban ethnic floating population. This part mainly introduces the concept and characteristics of the floating population of minority nationalities,to make clear about the urban floating population of minority nationalities which the article focuses on, which refers to those floating population of minority nationalities who move into the city from other place to work and live,but they don’t have a permanent city registered residence and the paper gives ananalyze on its characteristics.The paper also analyses the connotation,characteristics and composition of the rights and interests of the urban ethnic floating population.The third part:the present situation of the rights and interests protection of ethnic floating population in cities. It mainly analyzes the certain protection on the laws and regulations,political interests,social-economical interests and cultural educational interests.The fourth part:an analysis on the problems and the reasons that ethnic floating population is facing.This paper mainly discusses the existing problems in the aspects of political,labor and employment rights,social security,living, social discrimination, ignoration of the customs and the right of education.There are six reasons,including the institutional defects,the imperfect legislation,the absence of government, the difficulty of law enforcement,the social indifference and the weak concept to protect rights according to the law.The above analysis is to lay the foundation for the analysis of the countermeasures for the rest of the article.The fifth part:the countermeasures and methods to solve the problem of ethnic floating population.On the basis of the previous analysis,combine with the actual situation of ethnic minorities population,the writer puts forward the corresponding measures and methods to solve the problem.
