With the technology development, the genetically modified technology has walked into our life. More and more genetically modified food(GMF) occupied our table, but, because the uncertainty of its safe, consumers always unbelieve it. So, perfect the logo of GMF and make consumers owning the right to know are very important. There are three parts in this paper.First of all, talk about the necessity of establishing the system of GMF, mainly focus on its theoretical basis and the special features of the GMF. In terms of theory, divided into two parts, one is the theory of state intervention, from Adam Smith’s "invisible hand" to Keynes’s theory of state intervention, from western classical economics theory to write, to state the necessity of national intervention in the market. In terms of the actual situation of GMF in our country, discussed from two parts,one is that the government is the body to modify the GMF safety evaluation system, and the other it is also the regulatory system. Two is vulnerable groups protection theory, discussed from the consumers vulnerable position, mainly talk about the present situation that the information asymmetry about the GMF need to be identified, to safeguard the right to know of consumers. In the aspect of GMF, mainly talk about the uncertainty safety of the GMF, analysis the ecological environment, biodiversity, allergic and toxicity.Second, analysis the current legislation system of GMF in our country, in recent years concluded the related law about GMF, and summarized the legal problems in the field, such as the supervision body chaos, logo specification is not sound, and no unified standard; Difference with traditional food safety evaluation system and the technical detection system needs to be perfect, remedial measures do not reach the designated position, etc.Finally is to put up some legal advices about GMF, such as we need to have a clear regulatory body, improve the identification standard, improve the safety assessment of GMF and detection system, establish a fund system and insurance system, etc., and put forward from the administrative liability and civil liability to define the legal liability in violation of the obligations of GMF.Through the study of the problem, we hope to find a reasonable solution that make our market of GM to get the right track. Make people realized the result of the technology and be really provided by the law, make the GM technology truly benefit the people.
