The Construct Of Main Body Of After-legislation Evaluation

Legislation evaluation system refers to the systemic assessment of the laws andregulations after it has been drawn up.The legislative branch,law enforcement agencies,thepublic,experts,scholars and other main body use qualitative and quantitative analysis tounderstand the results achieved in the implementation of the laws and regulations,to findthe problems in the implementation of the laws and regulations,and to analyze thelegality,operability and pertinence of the laws and regulations in designing varioussystem,thus getting scientific and objective feedback to correct and repair its defectstimely,thus to play better roles in the system of laws and regulations.With the greatprogress in Legislative and the declining quality of some laws and regulations in recentyears,there have been many conflicts in the process of adjustment of social relations.Theseconflicts not only brought a lot of distress to the social development,and also underminedthe authority of the laws and regulations.Legislation evaluation system is an importantsystem to improve the quality of legislation in recent years.From the local power organs tothe Standing Committee of the National People’s Congress,they are all focus on legislationevaluation work actively.However, the main body of the evaluation system currently is stillrelatively simple, and there are many deficiencies,thus causing the concerns.At present,the design of our system has issues and defects in ranges and depth.We canlearn international experience and theory,and combine Chinese practice to promote itperfect gradually.I summarized the Main Body of System of After-legislation Evaluation inChina and analyzed the foreign legislation and its current system.The results show that inthe present stage to carry out the legislative evaluation,its evaluation body is the typicalinternal evaluation body.There are both certain advantages and obvious inadequacies.Toachieve the scientific and standardized legislation evaluation results,China should establisha wide range of diversifiable pattern of the main body of after-legislation evaluation.
