The Study Of Procuratorial Supervision On Designated Home Residential Surveillance Compulsory Measures

March14th,2012, the Fifth Plenary Session of the Eleventh National People’s Congressexamined and adopted the decision on amending the Code of Criminal Procedure. TheChinese Criminal Procedure Law appointed specified home residential surveillance as one ofthe coercive measures, that played an extremely important role in juridical practice for bothlimiting the freedom of the suspects and ensuring judicial proceedings. The specified homeresidential surveillance that new regulation appeared in Code of Criminal Procedure, itimproved the procuratorial supervision system of coercive measures, was helpful to ensureprocessing of criminal litigation procedures, and enhanced legal supervision of application ofcoercive measures situation for the office of the public prosecutor. However, in the course ofcriminal proceeding, this new regulation had shortage for the application, method of selectionof the legal supervision, and relevant ancillary support facilities; it needed improvement fromeffective legal support, such as judicial interpretation. This thesis will analyze theprocuratorial supervision of the specified home residential surveillance by three aspectsincluded essentials, problems and suggestions. And, the thesis will expound the essentials,matters of academic conflict, judicial operation and the issues of the practice.
