The Effect Of Unauthorized Disposition Contracts

The effect of the unauthorized disposition contract is the traditional problems in the civil law. Although Chinese Contract Law and relevant judicial interpretations has stipulated that, there exist a lot of disputes and puzzles. On the basis of some patterns of the unauthorized disposition contract in the comparative law, the thesis put forward that there is not necessarily link between the effect of the unauthorized disposition contract and the pattern of transform of property rights. Furthermore, based on the of analytical research in the related specifications in China and grounding on the jam of formations of credit rights, the thesis proposes that we should defined the unauthorized disposition contract as valid contract, in cases of which the thesis analyzes how to understand the bona fide and reasonable acquisition of the system.
