On The Crime Cognizance Of Organization Selling Human Organs

Nowadays,human organ transplant technology is a cutting-edge medical technology. It has become a medicine which is widely used in clinical treatment. Although organ transplants start late in China, it developed rapidly in recent years. Up to now, our country has been able to perform the liver transplant, kidney and other organs. Human organ transplant technology certainly helps plenty of Chinese patients with the loss of certain organ function. Most patients almost get reborn through human organ transplant. However, because people’s awareness is not strong, the donation of body organs and the rising number of patients who need organ transplants, lead to the serious shortage of human organs, which has given a rise to the commercial trade in human organs "industry".This paper aims to explore the interests of the crime’s driven motivation, in view of human organs and implementation of such crimes. This paper mainly divided into the following four parts: The first part made a through typical case analysis of the crime of organization selling human organs,and then explores the solutions to the problems.The second part emphasised on the crime composition of organization selling human organs of criminal offense,and lay a theoretical foundation.The third part combined the organization selling human organs with the typical cases of crime, discussing the issues of organization selling human organs.The fourth part is based on the theory of Criminal Law, solving the problems in defing the sin of organization selling human organs.
