The Study On Inland Property Declaration System In China Under The Perspective Of Comparative Law

Property declaration system is known as "Sunshine Act". As one of the effective measures for preventing and fighting against the corruption the system has been used by many countries. But this system hasn’t been implemented well in China. There are too many obstacles that hold back putting the system into effect. Therefore, how to solve out the predicament in implementing is the current big problem in our country. By the method of horizontal comparison, this thesis compares the property declaration system in America, Singapore, Taiwan and Hong Kong with it in the mainland. Analyze the reasons why this system can work well in those areas. According to carding the process of our country’s official property declaration system, we can find the reasons why this system cannot be carried out effectively in China. Based on the reasons and taking our country’s situations into account, we can put forward some countermeasures.There are four parts of this thesis. The first part introduces the basic theories of the Property Declaration System and makes analysis about the main functions of this system. The second part comparatively studies Property Declaration System in other areas and finds the reasons why the system can be implemented effectively. The third part introduces the current situation of Property Declaration System in our country. Based on the analysis of the problems and reasons in part three, the key point of the last part is to put forward the countermeasures. By drawing on Property Declaration System in other areas and combined with the reality of our situation, the last part put forward some concert measures from three aspects, the routing choice, system construction and supporting measures.
