| As a new decentralized, virtual currency, Bitcoin meets a widespread dispute. Someone accuse it as a tool for criminal, someone directly treat it as just a fraud since it was created. But only in few years, the value of bitcoin reach a highly price from nothing while it becoming a currency which can be exchanged in many countries. It makes us to face such problems:what actually is a bitcoin? Is there any difference in property criminal between bitcoin and normal virtual goods? And how can we get through the legal gray area of bitcoin. This paper mainly tries to define the essential property in Bitcoin system by analysis the basic characters of Bitcoin, and propose the conception of Valuable Data. Furthermore this paper will also discuss the problem of illegal possession in property crime combine with Bitcoin’s credit currency character, and in this way make an effort to wipe out the obstruct in application of criminal law about Bitcoin. After that this paper will discuss some specific criminal case in Bitcoin condition. |
