Part-time employment has been rapid development, on a global scale, which is characterized by its flexibility to break the traditional standards of labor relations and meet the needs of enterprises and workers. But there is a series of questions behind the development: Labor relations instability, poor working conditions, absence of social security and lack of equality protection. These problems prejudice the legitimate interests of part-time workers, in the long run is not conducive to the development of part-time employment.Labor Contract Law establishes the legal status of part-time employment from a legal perspective, but the provisions are principled. The provision relatively few and there is no comprehensive system, a lot of the problem is not clear, it did not really play a role in protecting the legal rights of part-time workers. This paper is based on a study summary. First, define the part-time employment than elaborate the concept, characteristics and the important of legal regulation. Secondly, through the analysis of the relevant legal provisions and facts, reveals the existence problems of the part-time employment. Labor contract rules are too flexible, lack of wage system regulation and social security system. Thirdly, by comparison and analysis, investigate the experience of extraterritorial. Finally, analysis our current system of part-time employment, put forward a sound of proposal.Mainly include: first, establish legislation guiding ideology that equality of treatment. Second, improve the part-time employment contract rules, entered into a written contract and build the labor protection system of terminating labor relations. Third, improve the law system of part-time labor wages, uniform standards for calculating wages, clearly identify the overtime issue. Fourth, establish the social insurance system of part-time employment, and make mandatory provisions for part-time employment in the social insurance legislation.We consummate our part-time employment legislation by taking these measures, in order to protect the legitimate rights and interests of part-time workers and achieve the goal of building a harmonious labor relation.
