Research On Criminal Law Protection Of Network Virtual Assets

With the development of cyber economy, people’s daily consumption habits have shifted from offline to online gradually. Therefore, network transaction has already become an indispensable part of national life. Due to intense development of the online game industry, the scale of network virtual assets trade is increasing day by day, and the value of the virtual property increasing. However, some criminals make use of the vitality and technicality of network to seek exorbitant profits under high risk. In judicial practice, theft, robbery virtual account, currency and other virtual property crimes increasingly which showing a growing trend. The public security organs in the investigation of such cases encountered confusion, therefore, given the criminal cases of infringement of network virtual property increasing, criminal law need to regulation, and from various perspectives to protect of network virtual property to facilitate the healthy and rapid development of China’s Internet space. In this paper, first of all, on the basis of the criminal law protection of network virtual property problem sorted out and discussed, such as the concept of network virtual property, characteristics, and necessity of the criminal law protection. Then analysis of the basic theory of criminal law protection of network virtual property, points out that the network virtual property infringement behavior and infringement of property crimes can fit, and combined with the problems of China’s criminal law protection of network virtual property, propose the suggestions of the criminal law protection of network virtual property.
