In recent years China’s real estate development and various types of infrastructure construction withthe rapid expansion of cultivated land in China, leading to decreased sharply, economic and social problemsarising from the increasingly prominent, rational utilization of land forces people to think calmly. In thiscontext, intensive land use theories emerge as the times require. By comparison, intensive land use researchin foreign countries started earlier, long-term practical experience and theoretical conclusion that they madesome achievements; in China, research on this problem is still in the initial stage.The intensive land use, according to government and people to participate fully and make thestandards of land use, and land use and planning of scientific proof, give full play to the role of the marketin the allocation of land resources, with the protection of the legal system and implementation, and thenchange the rural and city land utilization, improvement of land the efficient way. On the land intensive useof the connotation and extension of the accurate definition, improve the relevant legal system, standardizeand guide the government, help the public to systematically understand the economical and intensive use ofland value, but also help to promote public concern and active participation of land intensive economicaluse of the implementation of the system.Because our country economical use of land intensive research started late, the legislation has manyproblems. Specifically, the first is for the legislative structure of economical and intensive use of land ismessy, lack of system, the maneuverability is not strong. Reflect the more prominent are, the requirementsof the provisions for the principle, each place according to their regional characteristics have madeprovisions, but these Provisions are either based on their own interest in this area, the lack of awareness ofthe overall situation; or blindly copying the files required to cope with the lack of local characteristics. Inthe process of economical and intensive use of land, both to suit one’s measures to local conditions,according to local conditions and take the whole country into account, in line with national policies andregulations. The second is for a national potency of high-level legal economical and intensive use of landshortage, more focus on law, the lack of systematic."Rural land contract law","City real estatemanagement law" and other laws are involved, but all is according to the rules and regulations of each object of adjustment, the lack of unity and coordination. Finally, a more prominent issue is the lack ofsupervision, legislative driving force. In recent years, all in consideration of local interests, rely on the landtransfer income and security of land revenue, or indirectly by land as foreign investment negotiationconditions, institutional constraints on the enthusiasm of the economical and intensive use of land is nothigh, resulting in intensive land in our country at present the economical use of legislation slow progress.This paper attempts to analyses the related legislation of our country, the land use problems in practice,from Japan, Singapore and American, Hong Kong and Taiwan related legislation of our country, land usethe successful experiences, to find a solution to our land use path problem, put forward the opinions andsuggestions of land use system. The author thinks: intensive land use planning pilot status control, continueto promote the system of land use, land use standard specification, highlighting the legal guarantee, allowthe market to fully participate in the allocation of land resources, strengthen land consolidation in the roleof the rational use of land, strengthen the diversity in land use, integration, optimization of cross use of theland, emphasizing the priority to protect farmland, strengthen the supervision and management ofgovernment, pay attention to public participation and comments, promote social forces to effectivesupervision on land use, will be greatly helpful to promote the economical use of land intensive.
