This article is the study and research of the Resignation for Blame of civil servants in our country.Resignation for Blame is an extremely important political convention, which is not only very common inthe western governments but also a reflection of the democratic and constitutional principles. During the21st century, the Resignation for Blame has been started with the deep revolution in the Chinese politicalconstruction and the rebuild for modern government of accountability. China has already achieved asignificant goal by the hardworking party committees and governments at all levels, which contribute ingovernment of accountability, government under the rule by law, and the responsibility-askingadministration.The Resignation for Blame has been a new conspicuous phenomenon in Chinese responsibility-askingadministration. Every single event has been generated huge influence in both the public and the politicalcircle. What’s more important, the government officers who resigned for blame are sometimes leaders inChina. The reason why our society is putting more attention on the Resignation for Blame of civil servantsis not only the achievement of cultivating the thoughts of ruling-by-law into citizen’s mind but also thereflection of the dilemma of our country’s political system. The Resignation for Blame of Chinese civilservants is more administrative order than political normality. The concept of Resignation for Blame isnarrow and blurry. What’s more, the implement and result is much less than expected. Thus, deeply studythe Resignation for Blame in China is imperative. The author believes the Resignation for Blame is not thesame with Forced to Resign as well as Disciplinary Sanctions. It should be the behavior that civil servantsvolunteer to do based on the moral ethics; it should be the behavior that government officers are initiativeto resign after indirectly making huge loss or influences under their supervise. Based on the terminology,the Resignation for Blame is the method to undertake the political responsibility.First of all, this article will start with the definition of Resignation for Blame, which will clarify itby comparing Administrative Sanctions, Forced to Resign, and Recall. Then, the nature of Resignation forBlame will be defined in political responsibility, which will defer legal liability and strict liability.Combining the people’s sovereignty, responsible government, and representative democracy, the definition will discuss the law basis of the Resignation for Blame. After then, the author exhibits the facts of theResignation for Blame in China by investigating the object, condition, procedure and the result bycollecting numerous cases and data. Also, the author is trying to expose the obstacles and biases, whichconclude lack of authority, blurry concept, double standard, narrow range of responsibility-asking, lack ofundertaking liability, high risk of abuse, and lack of transparent, in the regulation and implement of theResignation for Blame. Next, the author probes in internal restriction and lack of supporting system andfinds out the reason of obstacles and biases, which are serious officialdom standard, lack of liability,imperfect administrative system, unsound supervise system, and lack of people’s participation. At the end,the author is trying to explore the perfect way to systemize the Resignation for Blame by borrowing foreignexperience and facts. What’s more important, the author is hoping to contribute in systemizing theResignation for Blame by offering the doable ways, which are completing resignation system as well as itssupporting system, clarifying the authority and responsibility, and constructing ethical basis.
