The arrest is the most severe compulsory measures, which is directly related to the personal rights of suspects. If not used correctly, it will bring serious damage to people’s personal rights. The newly amended criminal procedural law has greatly changed the rules about arrest and related system, with more detailed articles and more emphasizing the protection of human rights. So what we need to do next is to put it to good use. Now the quality of judicial personnel and the enforcement of law are both improved. But in practice, the cases are more complex, and the internal and external factors are influencing the enforcement of law. They make the arrest system malfunction to some extent. If this condition can not be changed, arrest system will not work well, and the function of criminal procedure will also be affected. This article is divided into three parts. In the first part, I will discuss the definition of arrest, the principles and conditions of arrest. In the second part, I will discuss the current situation and problems of China’s arrest system, with the practice of the people’s Procuratorate of Shouguang City as an example. In the third part, I will discuss how to improve the arrest system. My suggestion is reforming the mechanism of review of arrest, improving the custody necessary examination mechanism and other compulsory measures.
