The personal information of consumers in e-commerce is the combination of consumers’ specific personal information, which can exist in any forms and can be identified. The personal information rights of consumers in e-commerce refer to the rights, which are not subject to any others’ infringement, of understanding, owning and possessing to their own personal information, which is collected and saved in the Network in the form of data. They also refer to the rights of enjoying lives in the Network, namely the rights that are undisturbed by others. In e-commerce, the rights of consumers’ personal information can mainly be divided into the two kinds:the one which can be identified directly, the other indirectly. Of the two kinds, they all have legal characteristics of identifation, disposal and property rights attribute. This is also the theoretical basis of consumers’ personal information protection in e-commerce.To cope with the demands of the time on the personal information legal protection of consumers in e-commerce, the legal status of personal information rights should be established; a set of perfect consumers’ personal information legal protection system in e-commerce should be builded. The practice of consumers’ personal information protection in e-commerce in foreign country (region) is becoming mature. It provides a valuable experience in legislative purpose, legislative mode and regulation mode for our country. At the same time, the internationalization trend of consumers’ personal information protection in e-commerce also explains that as a basic human right, the right of consumers’personal information in e-commerce should also be focused and protected by law in our country. But at present, the situation of consumers’ personal information legal protection in e-commerce in our country is not optimistic. Besides there is lack of an united legislative mode and no clear basic principles, there also exists the problem of absence of specific content in personal information protection. So it is urging to build and complete our legal protection system of consumers’ personal information in e-commerce. To be specific, first we should choose a united legislative mode, write a specific personal information protection law and bring the legal protection issues of consumers’ personal information in e-commerce into it. Second we will determine the basic principles of consumers’ personal information protection in e-commerce, provide consumers’ personal information protection in e-commerce with comprehensive guidance. At last, we should establish a perfect and systematic specific content of consumers’ personal information legal protection in e-commerce as soon as possible, including the concrete construction of consumers’ rights, operators’obligations and responsibilities system.
