A Research On The Legal Issues Of Dormant Investment Of Taiwan Investors

The dormant investment of Taiwan investors have been existed for a long time. It is not a piece of cake to solve the relevant legal issues properly in order to regulate the investment behavior and protect Taiwan investors’legitimate rights and interests at the same time. It is not only one of the difficulties among the cross-strait investment legal issues that must be overcome, but also plays an important role in the cross-strait economic cooperation development which should not be underestimated. In this paper, the research on the legal issues of dormant investment of Taiwan investors, concludes the analysis on the relevant theories and the related judicial practice experience. It is expected that a reasonable way can be found to construct the legal system of dormant investment of Taiwan investors. On the other hand, it is also expected that the legal environment of cross-strait investment can be further improved.By combing the relevant standards with theories and practice, discussions and studies on legal problems of the dormant investment of Taiwan investors is carried out as following parts. Chapter One describes the concept and present situation of the dormant investment of Taiwan investors, and launches a full analysis on the causes such as historical reasons, regulations and policies, social factors. Chapter Two makes contents on relevant laws and regulations so as to find out the defects and disorder. Chapter Three talks about the related theories on dormant investment, combined with the special nature of cross-strait relations, in order to find out some theoretical basis for solving the common problems in judicial practice. Chapter Four puts the focus on equity confirmation disputes. And according to interest relationships in dormant investment as the standard of classification, this chapter analyzes the judgment methods with typical cases, so that it can provide suggestions for Taiwan investors to prevent risks initiatively. Chapter Five puts forward the reasonable countermeasures to solve the problem of dormant investment of Taiwan investors, and gives suggestions to make the mainland legal environment more perfect to attract more Taiwan investors.
