With the gradual transition Chinese economy from a planned economy to a market economy system, at the end of the last century, our country began to reform of personnel system in public institutions. The university teacher appointment system reform has become a priority among priorities and institutions in the reform. Especially with the "labor law","labor contract law" promulgated and implemented, adjusting the relationship between public university and teachers of our inter appointment caused widespread controversy in academic circles. The relationship between colleges and teachers adjustment, occupation development is not only related to the protection of the rights and interests of teachers and teachers, but also affects the overall quality of talent training, affect the development of education in china.The personnel system reform of public institution makes the teacher separated from traditional national cadres’series, become perform teaching functions of professional personnel, at the same time, universities have become the independent legal person. The University and the teachers sign the contract by themselves. However, in practice, with the deepening of reform, teachers and University of employment disputes have become increasingly prominent. In the transition of the economic system and personnel system under the background of the times, how to locate the problems to be solved the legal relationship between the University and teachers. In this paper, from the legal regulation of the employment contract, public universities and teacher’s employment contracts are analyzed and researched. Then from the adjustment of the relations among the public colleges and teachers in China,it is analyzed in theory on the relationship between public university teacher appointment. At the end of the article, public interests of College Teachers’relief and legal application under appointment are prospected.
