Dispute Question Research Of Bribery Crime

Bribery crime occurs earlier in the history of job-related crimes. Althoughthe Chinese and foreign criminal law scholars study increasingly, the theoryabout some problems of bribery crime still exists diffcrcnccs and controversy. Onthe basis of referencing to the relevant information and contacting the judicialpractice, the author, me, does research on the protection benefit, the scope ofbribery, the condition of seeking interests for others, accomplished offensestandard of bribery crime，and proposes my own claims and suggestions. Thewhole article is divided five parts as following:In the ifst chapter, the research status of bribery crime is introduced mainly,and the background of writing this article and the writing significance isconcluded.In the second chaptcr，domestic and overseas theories of the protectionbenefit of bribery crime and the focus of controversy are analyzed. My own pointthat no trading of duty behavior of national staff is the protection benefit ofbribery crime is proposed at last.In the third chapter, the bribery scope of bribery crime is analyzed. The threekinds of theories about the bribery scope are analyzed one by one. And theillegitimate interest theory is suggested to establish through legislation in ourcountry.In the fourth chapter, from the angle of theory, the condition of seekinginterests for others of bribery crime is discussed, the domestic relevant legalprovisions of seeking interests for others are analyzed, and the problems inpractice are listed.In the fifth chapter, by analyzing the theory of crime accomplishment andthe theory of the protection of legal interests of bribery, the conclusion is drawnthat the criterion of the crime accomplishment of bribes is the acquisition ofmaterial benefits and non-material beneifts, because it directly violates theprotection of legal interests of bribery.
