On China’s Grass-roots Election Of Trade Union

There is clear stipulation in The Trade Union Act that the election ofgrassroots democratic union is the way of democratic elections, but in real life,there exist various problems, and the most obvious phenomenon is the appointedsystem in the primary trade union. In order to solve this problem, our localgrass-roots trade unions have made the positive exploration and improvement, inwhich the most typical is the direct election of the President in the grass-rootstrade union. It requires that the Chairman and Deputy Chairman are elected bythe members in grass-roots trade union in a certain way. Only in this way can theUnion represent the interests of workers, only in this way can the work enhancetheirs’ strength against the employers in the game. Above all，it can play animportant role in many respects,such as improve workers’ motivation, stimulatethe vitality of trade unions, safeguard the interests of workers and alleviate thiscontradiction.This paper argues that our grassroots union election is the main route forworkers to fully exercise the democratic rights by relying on the collectivestrength to. Their right(the freedom right is organized by the right of assemblyand association) to vote is under the constitution, and represent democracydemands. Grassroots democratic union election is an important part of ourgrassroots democracy. Like villagers’ autonomy, it is a self practice by grass-rootscommunity. The current members of the union are delegated by the parties, andthere are a variety of problems in the process of election, such as the nominationcandidates can not effectively represent all the membership, because they areonly confined to a variety of groups, and d’ont even know the outside of thegroup^s situation; or the way of elections are out of date (an election is carried bysingle? candidate election or clapped) it made the election a formality withoutintroducing competition mechanism. Nowadays, non-public enterprises activelyexplore the grassroots trade unions in the country’s democratically elected, itmade grassroots trade unions begin to play their own roles gradually, which canchange a great many traditional problems that exist in the union election process.However, as for the lack of regulations and documents in the election process and the lack of appropriate safeguarding after the election, we can’t guarantee theoutcome of the election. It will blur the union responsibilities, which made thedemocratically elected grassroots trade unions don’t really work.Here are some suggestions about improvement of the grassroots unionelections by analyzing the representatives and the right of trade union in Ricohdomestic and foreign company:First of all, in order to improve the grassroots trade union democraticelection system we should pass amendments about the "Trade Union Law".Combined with Chinese current situation, the companies are in different sizes. Asfor the large enterprises, there are many members in the trade unions. In thesecompanies we can first scheduled a congress, in which we can select thecommittee as a candidate for the presidency in the election of the President. Orwe can also vote by the union on behalf of the Chairman. While for the smallenterprises with less than200people, we can elect the President of the uniondirectly. Secondly, we should i”mprove Interim Regulations of Union Electionabout Grassroots Organizations” as soon as possible, make some condition clear,such as the implementation of grassroots trade union conditions for democraticelections, the qualiifcations of candidates and the way to produce, the conditionsof trade union chairman，the basic election procedures，and how to hand atferbreak the rules;Specify the work about the direct elections around the country, so that it can beadopted by the legislation. By doing this all above, the trade unions canimplement our democratic elections, making the country grassroots trade unionscan play a real role, and safeguard the fundamental rights of union members.
