Ming Da Gao was a special criminal law in the early years of the Ming dynasty whensevere law was carried out to govern the country, and it embodied a concentrated reflectionof the supreme ruler’s legal will. This article wants to find out this special historicalorigin,describe the history of the law,and clearly show its short-lived fate. The analysis ofthis article involving effects of severe law, the disadvantages of legal system and theinfluence of the authoritarian political, reveals the inevitability of Ming Da Gao’sabandoned. The actual effect of harsh punishment was not satisfied. The legal system, notunified and unstable, leads to unexpected dangers. The law under the authoritarian politicalcannot give full play to the role. Thus it is concluded that the fate of the Ming Da Gao hadits historical inevitability. According to above analysis, by a different approach, the paperexpounds Ming Da Gao’s abandoned, can give us some revelations today: just heavierpunishment in order to solve the problem of crime, is considered to take temporarysolution not effect a permanent cure folly and continue for a long time, although the effectcan be achieved at that time. Legislation will inevitably have a top-level design, respectingthe rule of law, not arbitrary, constantly changing. Ruling class’s will rise to legal or system,over a period of time will always try to be brave, but will still be around by social forces,while the negative impact of law or system is more and more strong, and can’t be acceptedby society, the historical destiny of it will also follow Ming Da Gao’s destiny.
