The Decision on Amending the Criminal Procedure Law of the People’s Republic ofChina which was passed in the fifth session of the eleventh National People’s Congress onMarch14in2012was implemented from January1,2013. The newly amended CriminalProcedure Law established non-prosecution of additional conditions system for the minors ofour country, which play an important role in maintaining minors’ rights and interests andcarrying out the policy that will educate, influence and save minors. But at the same time, thenewly amended juvenile delinquency non-prosecution of additional conditions system is notperfect in legislation and judicial practice. This thesis will adopt literature research methodand case analysis to discuss the minor’s non-prosecution of additional conditions system fromfour parts. The first part takes non-prosecution of additional conditions system as startingpoint, elaborating the characteristics and application of the system in our country by blendingand analyzing related theoretical knowledge; the second part will make comment on juveniledelinquency non-prosecution of additional conditions system in our country, analyzing thevalue and imperfection in the system from the perspectives of advantage and disadvantage. Inthe third part, by reading literatures, analyzing and investigating the two main series of lawsabout non-prosecution of additional conditions system in major countries to lay foundation forcompleting our country’s related systems. The forth part will give advices on completingjuvenile delinquency non-prosecution of additional conditions system of our country from thelevel of legislation and judicial respectively.
