A Study On The Subject Of Crime In One-Man Company In China

One-man company is a new corporate form added to Company Law in2005, after which, One-Man Company crime comes into our view. In judicial practice, great controversy remains on whether one-man company is the subject of unit crime as well as various opinions in the law field. With the development of Market economy in our country, there will be a growing number of one-man companies, thus allowing more crime. Therefore a study on One-Man Company crime is necessary.This paper is divided into the following four parts. The first part is to make a summary of disputed points among typical case for further research. The second part is to take some fundamental problems and theories into consideration, which will help to illustrate the point. And the third part is to illustrate the point that one-man company should be the subject of the unit crime according to general crime of one-man company. Finally, the last part is to study the paper’s point in situations where the one-man company is uselessness and lacking in capital, etc.
