According to the data of Ivey Statistic, the number of network consumption springing up along with the rapid development of the Internet business, China’s consumption volume has more than one trillion eight hundred and fifty billion yuan in2013. At present, there are two most popular ways,B2C (business to custom) and C2C (custom to custom). B2C is35%of the whole the proportion, and still growing; C2C mode,like TAOBAO got the transaction amount about thirty-five billion yuan during the11th,2013November.With the rapid growth of online trading, the number of online contract violation is also large enough. According to data released by the Beijing Industrial and Commercial Bureau, half of received complaints are network consumer complaints.And the new rules of the Law of the People’s Republic of China on Protection of Consumer Rights have pay more attention on online consumption,fox example, the "seven days return without reason".This paper mainly discusses the network consumer default problem in trading, in order to seek effective law to solve the problem of Online consumption trading default rules.The paper has three parts.In the first chapter, from the perspective of the causes of default, this paper discusses the network consumption transaction contract default’s sake, and combined with the case example to analyze, clear the legal nature and the legal consequences of breach;The second chapter mainly talked about the network consumer contracts the characteristics of the liability for breach of contract, highlighted the network consumption trading contract with general contract difference;The third chapter is aimed at Chinese legal status and default problem situation to explore the rule of law to solve the problem, the author advocate Online Dispute Resolution.
