Since reform and opening up, the development of China’s economic is rapid, the rhythm of social transformation is accelerated; kinds of social problems caused in the process of social transformation have become unusually obvious. Assaultive injury criminal cases occur frequently, especially violent confrontations cases, which lead to minor wound, serious injury and even death, has no downward trend. The occurrence of regional stir-up-trouble crime is a common phenomenon in practice.This article takes Shenyang S district court stir-up-trouble crime cases as the research object, which using statistical analysis and case analysis based on the biology, psychology, sociology basic theories of crime. Firstly, describe the stir-up-trouble crime present situation from four aspects, including the total number, the crime subject, the behavior way and the punishment of the stir-up-trouble crime. Secondly, based on the analysis of the S district’s social status, analyzing the criminal reasons from four aspects, including the social factors, physical factors, psychological factors and crime situation factors. Social factors mainly include education and employment factors; physiological factors mainly include age and gender factors; psychological factors is refers to the criminal’s legal consciousness; the crime situation factors including time, place and onlookers. Finally, following the principles of the combination of theory and practice, he combination of biological and social, put forward the feasible suggestions from two aspects of macroscopic countermeasures and microcosmic countermeasures, which are aimed at the prevention and control of the Stir-up-trouble crime. The macro aspect mainly includes two aspects of the social prevention and control countermeasures and the criminal punishment prevention and control countermeasures. The micro aspect mainly from the family, school and the block aspects put forward prevention and control countermeasures for stir-up-trouble crime in S district of Shenyang city.
