The Research About The Illegal Fund-raising Behavior Regulation Pattern

With the sustained and rapid development of the economy market, private enterprises and individuals is also more and more demand for funds. The formal financial system cannot meet the strong market demand, those enterprises and individuals who urgently demand for funds have to find another way out, to walk on the road of illegal fund-raising. Since the early90’s, a series of illegal fund-raising appeared in china. After the "the decision on the punishment of the crime of undermining the financial order" passed by NPC Standing Committee, China formulated a series of criminal, administrative laws, regulations and departmental rules, demanded seriously cracking down on all kinds of illegal fund-raising behavior, the crime of fraud in financing can be sentenced to death. The legislative, administrative and judicial measures is rapid, punishment measures is also strict, but after twenty years of practice effect, illegal fund-raising crime is increasing instead of decreasing, and even the emergence of high momentum."We can’t help thinking, under the severe law, illegal fund-raising activities repeated again and again, is the problem of lax enforcement of the law or the current regulation mode itself? In this paper, I will start from the judicial practice and the legislative present situation, to rethink the current mode of regulation on illegal fund-raising behavior, and try to put forward a tentative reconstruction of illegal fund-raising behavior regulation pattern.
