Discussion On The Legal System Construction Of Environmental Public Interest Litigation In Our Country

Environmental problems are human social and economic development’sinevitable outcome, along with the world to explore and research the unceasinglythorough, the significance of development strategy’s and environmental protectionsare getting more focused on, it has also initiated the research on environmental publicinterest litigation. Since our country have made the reform,and welcome othercountry to our motherland, whether in theory or in practice,we have practiced theexploration of environmental public interest litigation many times and achievedbeneficial experience. The government continued to focus on the protection of thepublic environment,environmental protection will be based on the legal regulation andmanagement system. But on this environmental public interest litigation system’stheoretical research,most scholars still remain in the style of legislation, plaintiffqualification or litigation’s scope, in innovation and authoritative theory discussion isstill insufficient, has been unable to adapt to the environmental public interestlitigation judicial practice development. In this situation,on the basic of our countryand foreign environmental public interest litigation legislation and judicial practice,iwrite this essay, on this basis,i have made some analysis：The first part, the relatedconcepts,characteristic and theoretical foundation of environmental public interestlitigation,introduced this litigation system absolutely.In the analysis of the aboveproblems, based on the conditions of China, proposed personal opinions oninstitution-building, the plaintiff qualification program security.
