Research On Expectant Right Of Legal Problem

Analyses of the basic theory about Expectant rights system in the area of CivilLaw are always the focus and the most enduring analysis among scholars since itsbirth. With the development of the social economy, the Expectant Rights wasidentified by the laws for the specialization and economic value of it. The studies ofExpectant Rights System in Germany have affected our Chinese experts. Under theinfluence, civil law experts have analyzed the Expectant Rights System according tothe reality of Chinese legislation. Because the field in China is budding, manyresearches are immature. This paper analyzes the essential theory of the ExpectantRights System based on the previous researches, Reopen a definition to the notion,kind of expectant right, and put the classification of expectant righ into expectantrights of property, expectant right of credit, expectant right of succession, the problemfinally existing from the severalty component inflicts integrity to the expectantright,in order to make the application of Expectant Right System better in the practice.In this paper, the writer combines reversionary interest of expectant rightstogether with the property rights, creditor’s rights and inheritance rights. Andrespectively constitute expectant rights of property, creditor’s rights and inheritancerights. Therefore, the writer divided this paper into four parts:The first part is the overview of expectant rights system. This part is the start ofthis paper. First of all, this paper has a brief introduction of this system about theorigin of the system. Secondly, the writer joined the notions of scholars in differentcountries toward this system, then make analysis and definition. Meanwhile, makeclassification and summary of this expectant rights system.The second part is expectant rights of property. The writer makes a summary ofexpectant rights of property and its different types with a detail analysis. Meanwhileintroduce the conservation status of expectant rights of property, in the end with asuggestion about this. The third part is expectant rights of creditor; the writer makes a summary ofexpectant rights of creditor and its different types with a detail analysis.The fourth part is expectant rights of inheritance, first of all a brief introductionof this. Then make analysis of its types, in the end show some suggestions of theexisting problems.
