E-commerce,which has changed the traditional way of trading, andsaved transaction cost.With the high-speed development ofe-commerce,the third-party electronic payment modes emerged. It actsas a agency or security agencies throughout the course of the electronictrading, and provides a fast, convenient trading platform for consumersand businesses online shopping.However, with the rapid expansion ofthird-party electronic payment industry, the loopholes in legal andregulatory has been showing.The resulting legal risk is greatly harm forthe legitimate interests of consumers,also obstruction on the developmentof third-party electronic payment industry.There are five criminal activities about using third-party electronicpayment,such as, credit card cash,theft, fraud, money laundering, andgambling. In the particular computer environment, there are a lot ofpressure and difficulties in judicial practice,for a hidden, complexity, etc.It is particularly important to establish an appropriate system of criminallegislation. However, our criminal legislation on the adoption of athird-party electronic payment criminal relatively backward areas. Inrecent years, the system is improving by amendment or judicialinterpretation, but still not established a systematic criminal regulationsystem.And there is the lack of academic research in academic theory,only a small number of scholars have carried out the crime analysis andresearch.This article will “Guarantee type” third-party electronic payment asthe main object of study, to study five criminal activities, by analyzing inthe form of case studies and on the legislative status of the sort. On thisbasis, learning from the successful experience of foreign legislation onChina’s legislation on the use of third-party electronic payment forcriminal offenses, suggestions and improvement ideas.I hope to betterprotect the legitimate rights and interests of online consumers, but alsohope that through criminal regulation can make third-party electronic payment industry to embark on a healthy steady path of development.
