Punitive damages, a legal system originated in common law countries.Initially, the system has met the unanimous rejection of the civil lawcountries, but with the gradual development and perfection, together withthe in-depth development of economic globalization, punitive damagessystem has been accepted and adopted by more and more countries.TheConsumer Protection Law of legislation and system of punitive damagesis introduced to our country for the first time. Subsequently, Series ofregime figures about punitive damages have been reflected in "FoodSafety Law","judicial interpretation of the sale of real estate on the trial",and" Tort Liability Act" in2009. As has been seen that punitive damagessystem itself has a lot of advantages, and the introduction of punitivedamages system can contribute to solving some of the problems in thereal world and curbing some criminal violations.However,theestablishment and application of punitive damages in our country have along way to go. We also need to continue to learn lessons from theexperience of other countries according to our domestic situation in orderto have continuous development and improvement. Thus, it can play itsdue effect slowly and highlight its important role.
