The futures investors are constantly in a disadvantaged position comparing to the futures exchanges and futures companies due to their technical and professional constraints and lacking of information. This unfairness is especially outstanding on the futures market based acquisition of information. It requires the inclining of the law to the protection of the vulnerable groups to achieve fairness and justice effectively. On the other hand, only if the futures market truly protects the legitimate interests of the investors, can it provide investors a sense of security and confidence therefore seek for long term steady development. Hence, it is an important topic faced by the China’s futures market in the future, to and maintain the open, fair and justice market to the maximum extent through construction of the relevant legal systems, therefore protect the legitimate interests of investors comprehensively and effectively.This article investigates and compares the domestic and foreign futures legal systems from the perspective of legal protection of futures investors. The advanced experiences of futures legal systems was studied from foreign developed capital markets, as well as the in depth analysis of the deficiency of current domestic systems. Approaches to the legal protection of futures investors were discussed on both macro and micro level. Maintaining the safe, efficient and fair futures market order and the respect for contract spirit were demonstrated to be the basic principles of futures legal system. Advices on legal protection of futures investors were given with consideration of current development situations of the China’s futures market.
