The Study Of Patent Insurance System

ABSTRACT:With the deepening of economic globalization, the concept of patent is very popular now. More and more companies use patents to earn interest while patent infringement disputes have occurred in this process. Especially in recent years, Chinese enterprises to enter the U.S. market experienced a large number of "337investigation" for the patent disputes. These disputes will have an bad effect to the companies even lead to the bankruptcy of there companies because of the subject of litigation involving a wide range of complex legal relationship, the difficulty of the proof, the more difficult diverse infringement ways, the high cost of litigation and the longer litigation period. The companies need effective patent infringement insurance to adequate protection of their rights.In2013the State Intellectual Property Office of the P.R.C gradually expand the scale of patent insurance in part of areas and actively develop the patent insurance coverage and build multi-peril patent property service system. Patent insurance as an important way to protect small and medium enterprises becomes more important.Apart from the preface and the conclusion, this paper consists of four parties. The first part introduces the basic theoretical knowledge of the patent property and the patent property insurance. The second part compared the various patent insurance system in the U.S.A, Euro countries and Japan. The third part analysis the possibility and the necessity to carry out the patent insurance in China. The forth part express the means of opening up patent insurance in China which based on the theory and the practice from the perspective of the insurance companies and the government.
