Environmental issues have been the focus of widespread concern countries in the world, global warming, energy shortages, air pollution and other problems always threaten human survival environment. As China is the world’s largest developing country, the environmental pollution problem also can not be discounted. Although the pollution of the environment of the Criminal Law of the relevant provisions of sin do, but in terms of protecting the environment defects and loopholes still exist, only the criminal legislation, can protect the environment further.This paper is divided into five parts:First, introduce the concept of environmental pollution and crime characteristics, provide a basis for later research. Second, introduces the crime of judicial determination of environmental pollution, analyzed crime or sin boundaries, as well as how to determine the subjective aspect of crime. Third, analysis the setting of environmental pollution crime, and punishment to the crime, and the use in practice, draw penalties defects of this crime. Fourth part is mainly based on the analysis of the third part, the penalty for the crime of polluting the environment settings, and the author puts forward some sound advice pollution of environmental crimes, including the strengthening of the magnitude of the penalty, taking the punishment diversification principle, the provisions of this crime danger guilty and Aggregated Consequential, and improve property punishment, torture and other measures additional qualifications.
