The Studies On Testimony Of Public Security Examiner

Abstract:Testimony of examiner system is an important part of the forensic system. Testimony of examiner not only refers to the fairness of court proceedings, but also refers to the justice of fact-finding case. The accrediting bodies of public security undertake most of the identification tasks in criminal proceedings. But the rate of identification in public security was low, which had some adverse effect on the clarified truth. With the development of testimony of examiner system, which experienced the moment that it was from null to implicit, from implicit to clear,and finally from clear to particular attention. Especially with the revised Criminal Procedure Law in2012, it made a clear request on testimony of examiner. Through the empirical research on the testimony of public security examiner in Hunan Province, which reflected some current problems in our country, just like a dual identity in testimony of public security examiner, strong randomness on attitudes in identification and so on. In order to regulate the testimony of public security examiner, some ways should be done as follow: adjust the functions of accreditation bodies in public security, norm appraisal process to ensure the quality of identification, enhance legal literacy of examiner in public security, strengthen testified ability of examiner in public security, improve incentive assessment mechanism of public security, and enforce the road to professional development of the examiner.
