Abstract:In the aspect of the prison work involved,"the eighth criminal law amendment" well embodies the spirit of criminal policy of temper justice with mercy. One side, it adjusts the penalty structure strictly, for instance, limits the commutation of two-year reprieve criminals; extends the sentence of combined punishment for several crimes; extends the minimum prison terms of two-year reprieve criminals and life imprisonment criminals; modifies the parole condition and so on. On the other side, it adjusts the penalty structure leniently, for instance, abolishes the death penalty for13charges; legally regulates the lenient punishment over juvenile delinquents and elderly offenders and so on. These adjustments are a direct result of the offender’s prison term growth and the increase in sick and elderly offenders, even some criminals are restricted commutation and parole, which exert great impacts on the offender’s education reform and labor reform. Prison facilities and police team construction are also facing many new challenges. To address these challenges, we need to strengthen the psychological health education of criminals. At the same time, psychological unblocking and psychological intervention will be carried on to criminals, and the construction of the prison culture will be strengthened. While exploring new education methods, we have to try to bring criminals into the social medical insurance category, so that criminals can reform in hope. Moreover, the prison facilities and professional talents will be increased, as well as the prison police’s responsibility consciousness and management level will be improved.
