Research On The Connection Between Administrative Review And Administrative Proceedings

Administrative review and administrative proceedings are two important way of resolving administrative disputes, both have their respective advantages, independent of each other, with mutual irreplaceable role in resolving administrative disputes. At present, because of the problems existing in the convergence issue, led to the connection of administrative review and administrative proceedings are disjointed, contradiction, can not give full play to the role of administrative review and administrative litigation. Therefore, the research on connection of administrative review and administrative proceedings is very important and necessary.This paper firstly describes the theoretical basis of administrative reconsideration and litigation cohesion system, to research the exoterica of administrative review and administrative proceedings. Second, analysis of China’s administrative reconsideration and litigation cohesion problems. And then to Germany, the United States and Japan Administrative Reconsideration and litigation cohesion system and comparative analysis, draw lessons to perfect our system of connection of administrative review and administrative proceedings. The improvement of administrative review and administrative proceedings engagement system is proposed on the basis of comparative analysis.
