The Study On The Supervisory Authority Of The Standing Committee Of Municipal People’s Congress

The system of the people’s congress is China’s fundamental political system. Constitution and laws stipulates the People’s Congress and its Standing Committee with the right to legislate, decide, supervise, appoint and dismiss. Among them, the supervision is in the essential basic position because the exercise of supervision can ensure the normal exercise of the other three rights. But in real political life, supervision plays a less important role as it should be. The right to supervise of the Standing Committee at all levels has not been fully casted.Therefore, this article will study the supervision of the Standing Committee of Municipal People’s Congress, with the methods of theoretical analysis and empirical research, trying to find out the effective ways to enhance their right to supervise.The article is divided into four parts.The introduction section introduces the source of ideas and legal basis of supervision of the Standing Committee. It combines other researchers’study to analyze the concept, characteristics, factors, subjects and objects of the Standing Committee. It also gives out a brief description of the development of the Standing Committee supervision work since1949.The second section takes the People’s Congress of Mianyang as an example to summarize the exercise of supervision of the Standing Committee of Municipal People’s Congress.The goals of supervision are to ensure the implementation of the Constitution and laws. It also needs to make sure that the work of the Government, the People’s Court and the People’s Procuratorate meets the wishes of the people. As for the effect of the supervisory, these two priorities have got the basic guarantee, but there is still much room for improvement. Since the founding of new China, especially since the Reform and opening up, the supervisory power has greatly improved with richer methods, deeper level and standardized work practice.The third section mainly analyzes the problems and causes existing in the exercise of supervision of the Standing Committee.The major problems of currently supervision are:the use of monitoring tools is not enough, blind spot monitoring object exists, and the monitoring process are mere formality;These problems are caused by many reasons, such as the system is not smooth, lack of cognition, the system is not perfect and disability.The fourth section is the key, mainly focusing on the approaches to strengthen the exercise of supervision.The primary way is to improve the party’s leadership and governance. Only in this way can we completely straighten out the relationship between Party Committees and People’s Congresses and ensure the supervision right of Municipal Standing Committee has been put into effect.The second way is to intensify the awareness of People’s Congress supervision. Social atmosphere is essential. We need to make sure that people are aware of not only the contents but also the benefits of the supervision of the People’s Congress.The third way is to complete the supporting system construction. In order to support the further supervision of Standing Committee.The fourth way is to strengthen self-construction of the Standing Committee of Municipal People’s Congress.In summary, the supervision work of the Standing Committee of Municipal People’s Congress has made considerable progress. But there is still much room for improvement comparing with the requirements of the Rule by Law. We must take effective measures to improve and strengthen to advance the process of democratic and legalized construction.
