Research On Public Prosecution System Of Criminal Reconciliation

Today’s emphasis on maintaining social harmony and stability in our country，the state， society and people also pay more attention to social disputes over howto get a better solution. Modify the criminal system， before the lawful legitimaterights and interests of the victims have not been fully safeguarded， the criminaleducation and guidance is not perfect. So the introduction of criminalreconciliation system has become one of the inevitable trends of the rule of lawconstruction， I with the introduction of criminal reconciliation system in the caseof public prosecution for bright spots. Public prosecution system of criminalreconciliation pay more attention to protect the human rights of the victim， theidea will inject new vitality for our country’s criminal system. The article is dividedinto four parts; the first part is the summary of criminal reconciliation system in thecase of public prosecution， the concept of public prosecution to criminalreconciliation， contract， criminal， compensatory， on analysis， also analyzedthe characteristics of the rolling of the operation situation of the system. Publicprosecution to criminal reconciliation a legal exclusive terms and concepts ofvisualization， help people to learn to accept in our country. The second part ismainly to public prosecution system of criminal reconciliation theoretical basis andvalues are analyzed. Theoretical basis in restorative justice theory， the criminalpolicy of tempering justice with mercy， the principles of respect and safeguardhuman rights， the system but also the overall requirement of building aharmonious society. Value mainly through three aspects， justice value andefficiency value balance value were analyzed. The third part is the shortage ofpublic prosecution criminal reconciliation system in China， the fourth part is theimprovement of criminal reconciliation system in the case of public prosecution inChina. The author tries to analyze the system itself， and according to the current clear the system of the applicable laws and regulations. Although China establishedthe system of public prosecution criminal reconciliation， but should soberlyrealize the system still has many deficiencies， I hope this article put forward theperfect measures of can in the future play a certain reference role in thedevelopment of the system.
