Cloud computing swept the world in an unexpected speed in the nearly eightyears since it first appeared in2006. It turns to be a core element of a new round ofinformation technology. In academia, the research in the context of cloud computingcontinues to deepen, and it has now extended to its associated applications, simulation,model, performance optimization, testing and many other fields. In industrialproduction, many world well-known companies including Microsoft, Google,NetSuite, Rackspace are constantly introduced its proprietary cloud computingservices platform. All previous social change verifies the truth that technology is thekey to leading an institutional change. Yet intellectual property protection was toprovide foundational guarantee for technological innovation. A review of thedevelopment of China’s cloud industry shows that as the rapidly deployment ofhardware cloud computing in2009, and cloud computing demonstration projectsexplicitly included in the five-year plan of China’s emerging industries, cloudcomputing in China enters a substantive stage of development in the strong support ofthe Internet companies, infrastructure operators, IT hardware and software businessesand local governments. New issues appear inevitably as the expand of industry scaleand the acceleration of development, such as how to determine the object of the patentin the cloud environments, how to improve the existing patent examination way, andhow to resolve cloud computing patent disputes when it happens, etc. In view of this,it is necessary to give a systematic understanding to patent issues related to cloudenvironments.In the study of cloud computing technology patent protection, the author focuseson several important issues in the process of patent protection--the patent object,patent examination standard and when some related cloud computing technologypatent infringement dispute occurs, the applicable rules and remedies we can use.Through outlined the above questions, it will help the general publica betterunderstanding the characteristics of cloud computing technology patents. In practice,it also provide references for patent protection. Especially for cloud computingpatentable analysis in business methods, business models and algorithms,optimization recomendations for the current authorization, as well as identify andsolve the cloud computing technology patent infringement in China, the above researchs have certain significance.
