Study Of Supervision On Industry Associations’ Price Monoply Behavior

Industry associations are becoming increasingly important in reducing competitive costs, with the prospering domestic market economy, improving market competition efficiency, and promoting healthy market competitions. However, since industry associations do have limitations, and could be driven by the industry’s interests, once monopoly agreements are reached and measures are implemented to restrict competitions, the market competition environment would be disordered and damaged, and lawful rights of both operators and consumers would be violated, which could eventually do a negative effect on the order and the operation of market economy. With the deepening of price management system reform, the price supervision of monopoly industry has already drawn much attention. Industry associations are involved in almost every publically reported cases on competition restriction. Even though the pricing mechanism in monopoly industries is now gradually improving, yet China’s Anti-Monopoly Law has only given general regulations on industry associations, with imperfect related supporting laws and provisions. Therefore, there always be various barriers to the regulation of industry associations. At present the domestic price supervision of monopoly industries still has numbers of problems to be solved, and needs further improvement and strengthening.This paper studies the price monopoly phenomenon in industry associations, and gives analytical discusses on problems that exists in its supervision. In the first part, this paper gives introduction on industry associations and illustrates the significance of this research. Based on the recent research status home and abroad, research contents and research methods are given to educe the focus of this paper-the price monopoly phenomenon in industry associations and its supervision. Secondly, this paper elaborates the history and development of the supervision on industry associations’price monopoly behavior. And also one typical case seized in province S and some other publically reported cases are cited as references to analyze the characteristics, forms and social harm of domestic price monopoly involving industry associations. Thirdly, this paper focuses on the analysis of recently exposed problems on the supervision of industry associations’ price monopoly behavior and its origin. At last, aiming at these problems and its reasons, this paper proposed several suggestions to improve and enhance the supervision of industry associations in its price monopoly behavior.
