On Legal Strategies To Introduce Competition Mechanism Into Rural Land Exchange Market

Various reasons such as legal restrictions on the transfer of rural land, urban-rural dual systemarchitecture, rural land procedural obstacles, resulting in the current situation of China’s ruralland transfer market, a lack of competition mechanism. As the transfer land price does notreflect the real value of rural land, farmers are not willing to transfer the land, which affectingthe process of the country’s agricultural modernization and mass-productiveness. As the ThirdPlenary Session of the Eighteenth Party Congress proposed to deepen the reform of rural landsystem, the determination of the establishment of a unified urban and rural land market, givingfarmers more rural collective assets of property rights, there will be a channel of theintroducing competition mechanism to the rural land market exchange. It is meaningful tointroduce the competition mechanism into the rural land market, as which can be helpful toimprove the utilization of rural land, achieve the optimal allocation of resources of the ruralland, and protect the interests of farmers’ land. The theme of how to introduce competition intothe rural land market and how to innovate the competition mechanism of rural land market isthe core of this paper. Excluded the preface and the conclusion, this paper is divided into threeparts: The first chapter is about the transfer market situation analysis and moreover theexisting problems of farmland transfer market, and the barriers which will arise as theintroduction of competition mechanism; Chapter II, mainly study overseas farmland transfermarket competition mechanism and try to explore the competition mechanism of the oversealand transfer market; Chapter III, discussing the principles as a starting point of theintroduction of competition mechanism into the rural land transfer market. I think: as theestablishment of a unified land transfer market, giving farmers control over land transfer in theagricultural land transfer process, release the countryside land transfer restrictions will be vitalto solve the problem of introduction of competition mechanism into the agricultural landtransfer market. Referring to the competition mechanism of legal concepts in other areas ofproduction and management and to discuss the formation of rural land transfer marketcompetition mechanism, and thereby to improve our rural land transfer market competitionmechanism, which defined the innovative direction of this article, is the way of introductionof competition mechanism into our farmland transfer market.
