Any right will be abused without supervision, and judicature is no exception. Realization ofjudicial justice cannot do without effective supervision of media. Supervision of media onjudicature will reveal judicial power to the public, discover in time black case work and activitiesof bending law for personal gain, effectively prevent miscarriages and safeguard judicial justice.However, because of lack of current legislation, attribute differences between media andjudicature and their specific disadvantages, conflicts between the two remain in practice. One ofthe prominent features is that improper reports and comments on judicial cases will infractjudicial independence, and even become media trail, which damages judicial justice. Thus, howto avoid improper intervention of media in judicature, to balance relationship between the twoand to realize benign interaction are important constitutional issues, which concern freedom ofthe press and judicial independence and are worth studying. On premise of fully affirminglegitimacy and positive effects of supervision of media on judicature, paper stresses to analyzenegative effects on judicial independence and justice because of improper intervention. Paperwill start from analyzing conflicts between the two and ways media influences judicature, statereasons of conflicts from different angles and propose measures to avoid improper interventionby learning from legislative experience of other countries and combining our actualcircumstance.
