On The Credit Punishment System Of Dishonest Person In Enforcement

Legal justice is embodied in the judgment and authority of laws is realized from enforcement.However, difficulty in enforcement has become a common problem. The Supreme People’sCourt drafted Several Provisions of the Supreme People’s Court on Announcement of the List ofDishonest Persons subject to Enforcement, hoping to urge the establishment of a social creditsystem from legal ways such as the credit punishment system of dishonest persons subject toEnforcement and intensive efforts to combat evasion of Enforcement. The thesis is going toanalyze the credit punishment system of dishonest persons subject to Enforcement in thefollowing aspects. First, the credit punishment system of dishonest persons subject toEnforcement is a complete and well considered system. Second, since the implementation of thesystem, some success have been achieved, yet problems are also exposed, including theimperfect supporting system design; lacks of legislative considerations of punishments related topersonal privacy, reputation and credit rights; and lacks of security system. Finally, the creditpunishment system of dishonest persons subject to Enforcement can be improved from aspectssuch as the system itself, supplementing related laws and regulations, and the improvement oflegislative process.
