Research On The Protection Suspects Of Material Personality Rights

Criminal law in the protection of human rights is an important part of the humanrights provisions of the Constitution, both with the universality of human rights, but alsohas its own particularity. In criminal proceedings, in order to guarantee the effective formsof state power, the suspect must take appropriate enforcement measures, such mandatorymeasures might conflict on the human rights of criminal suspects, such detention isnecessary. In the face of state power, the rights of individuals seem extremely small, andviolated the criminal law of the citizens, their rights are more susceptible to abuse of statepower, then the basic rights of every person has inviolability, so in criminal proceedings,the suspect although the person is suspected of a crime, but the basic human rights,including their right to life and health, body, freedom, dignity, property, residential andother non-law shall not be denied, the suspect can not be discriminated against because ofsuspected or unequal treatment. However, in China, due to various reasons, there are a lotof violations of the suspect substance personality rights, such as hide and seek, turbidwater, sleeping dead, these prompted us to have to face the fact that human rightsviolations. Matter of personality rights of criminal suspects as the basic content of humanrights, protection of human rights is the first step, it mainly refers to the right to life, theright to health and the right to health. In this paper, the basis of human rights violations inthe summary judicial practice of criminal proceedings on the analysis of the causes of thephenomenon and identify deficiencies of existing criminal law, in the experience ofadvanced foreign institutional premise, combined with China’s reality, in order to find theimprovement of the policy.
