In December2013, the National People’s Congress Standing Committee passed aimportant resolutions in the meeting about “the decision on the abolition of the relevantprovisions of the law of reeducation-through-labor”, but the “admonition education" casesand problems in the era of abolition of reeducation-through-labor triggered my thinking andopinion, with these thoughts I come up with “the study of legalization of governance modelin the era of abolition of reeducation-through-labor", which specifically is to explore, afterthe system of reeducation-through-labor is abolished, whether we should construct a legalsystem, which can be used to replace the system of reeducation-through-labor, to make up forthe legal deficiency in the era of abolition of reeducation-through-labor, which not only canimprove the disadvantages of the system of reeducation-through-labor, but also can playthe adjustment that processes the reeducation-through-labor system and amendment of socialrelations, crime prevention in order to achieve and maintain social order, safeguard humanrights, protect the legitimate rights and interests of citizens, and question the way to makethe legislation of alternative system effective.This thesis first will start off from the system of reeducation-through-labor and itsabolition, finding the root of problems in the era of abolition of reeducation-through-labor,and verifying that it must construct a legal alternative system for it. Second, I will be bydrawing on the various analysis of the academic sources and legal alternative system ofpractice field, as well as their hypothesis and weakness, which try to concludes that theconstruction of legal alternative system’s experience. Finally, I will propose that the conceptof education-and-correction system, which will make some concrete ideas for its property,characteristic, necessity of its existence, applicable scope, judicial procedure, execution mode,that not only can improve all sorts of drawbacks of the reeducation-through-labor system, butalso can solve the problems appear in the era of abolition of reeducation-through-labor, inorder to achieve the purpose of the study of legalization of alternative system in the era ofabolition of reeducation-through-labor.
