On The Probation Concerning With Commercial Bribe

Commercial bribe exists everywhere around the world. Since our country adopt reform and open policy, with the fast development of economy, however, behavior is a kind of unfair competition in the market economy, commercial bribe crime grows quickly, which results many serious social problem. To protect our country’s social market economy grows healthy, commercial bribe crime should be punished effectively. The effective of the probative measure to the commercial bribe is a precondition of the regulation of the commercial bribe crime. Since there exists some defect in the our country’s criminal procedural code and anti commercial bribe crime probative measures, it is unbeneficial to punish the commercial bribe crime, anti commercial bribe crime should reach two goals,one is the protection of human right, the other is to promote the efficient of the rate of the anti commercial bribe crime. The paper give an examine to the problem which exists in the commercial bribe crime realm, and introduce some legislation experiences from other country’s anti commercial bribe law, finally the author give some measures on our country’s anti commercial bribe law.This paper can be divided into four parts.firstly, the author gives some description on the concept and the characteristic of the commercial bribe crime;secondly, the author discusses the problem existed in our country’s commercial bribe crime probative measures; thirdly, introduce some legislation experiences from other country’s anti commercial bribe law; fourthly, the author give some advice on the legislation of probative measures to the commercial bribe crime probative measures, including principles of commercial bribe probative, the preliminary probative procedure, and endow some special power to the police concerning with commercial bribe.
