A Study On The Mechanism Of People’s Mediation In Settling Group Disputes Arising From Urban Housing Demolition

At present, China is facing significant strategic opportunities andincreasingly prominent contradictions among the people as well. Withcontinuous development of socialist market economy and progress ofvarious reform measures, social contradictions and conflicts arediversifying, and group disputes have occurred from time to time, someof which even resulted into severe impacts on social stability. In the1980s, Alternative Dispute Resolution (ADR) became popular in foreigncountries, providing a reference for resolving social contradictions. Undersuch circumstances, it bears great practical and theoretical significance tostudy how to solve group disputes via people’s medication, i.e.Alternative Dispute Resolution with Chinese characteristics and historicaltraditions.Based on the cases of solving group disputes from urban housingdemolition through the efforts of people’s mediation in P District, thisthesis studied the theories such as conflict theory, social combustiontheory (SCT), governance theory, etc., and adopted research methodologyincluding documentary method, case analysis, interview&investigation,etc. It analyzed many cases about people’s medication involved into solving group disputes, and studied the methods of people’s medicationby cross using legal perspective and sociological perspective. It’s foundthat people’s mediation plays a positive role in solving group disputes,including early warning, communication and dispute solving, etc., andworks very well in preventing group disputes from escalating into massdisturbance. This analysis further clarifies the specific targets and stepswe need to notice when solving group disputes by way of people’smediation, thus better instructing us to apply people’s mediation to solvesuch disputes, which will provide beneficial practices for strengtheningand innovating in social management.
