The Research Of The Third Party Of China

The third party is an important system of civil procedure, so thatestablish and perfect the system of the third party has play a decisive roleto promote the reform of civil procedure. However, because if reasonssuch as insufficient legislation, contradiction between laws and judicialinterpretations, there are many defects lying in the system of third party.With the development of society and the increasing complexity of dispute,more and more people participate in action as the third party, the currentsystem seems powerless and not able to meet the practical requirements.Therefore, it’s meaningful and significant to introduce and reconstructChina’s third system party.This dissertation is divided into four parts. The first part is basictheory, including the overview of the third party system, which talksabout definition, development, value and function of the system. Thesecond part focus on foreign legislations including American, Germany,Japan and Soviet Union, analyzes their contents and types to pave theway for study in the third party of China better. The third part analyzesthe definitions, types, cases, problems and defects of third party system ofChina. At the same time, this part introduces, analyze and discuss two different reconstruction plans of the third party system of China. Thefourth part, in view of current systems, provide some useful advices fromsummarizing authors practice experience.
