The Research On The Synchronic Supervision Of The Implementation Of Penalty Alternation

For the first time the amendment and enforcement of the new "CriminalProcedure Law" formally established the system of the synchronicsupervision on the implementation of penalty alternation from the legislativelevel.It’s very important for prosecutors persisting in strengtheningsynchronic supervision on the implementation of penalty alternation toensure uniform implementation of national laws, regulate implementations ofpenalty alternation and maintain the seriousness,stability and fairness ofcriminal judgments.This paper analyzed the definition,the content,the theoretical basis andthe practical significance of the synchronic supervision on theimplementation of penalty alternation, compared the supervision on theimplementation of penalty alternation in foreign countries,expounded the status and problems of the synchronic supervision on the implementation ofpenalty alternation in our country,and put forward a number of specificsuggestions to improve the system of the synchronic supervision on theimplementation of penalty alternation in our country.This paper is dividedinto four parts.The first part is the basic part. In this section,the definition,thecontent,the theoretical basis and the practical significance of the synchronicsupervision on the implementation of penalty alternation have been analyzed,which has laid the groundwork for discussing the existing problems of thesynchronic supervision on the implementation of penalty alternation work inthe following.The second part is the comparison part. This section firstly introducedthe foreign supervision mode of the implementation of penaltyalternation.Then it compared the similarities and differences of synchronousmode between our country and foreign countries.The third part is the analysis part. In this section, the current situation ofthe synchronic supervision on the implementation of penalty alternation inchina has been firstly discussed. Then the existing problems of synchronicsupervision have been also emphatically analyzed.The fourth part is the perfection part. In view of exiting problems,some suggestions have been proposed to perfect synchronic supervision system ofthe implementation of penalty alternation.
