The collective management of copyright is one of the most effective system of copyrightprotection. It is used to manage large scale rights. Its purpose is to seek the balance between therights protection and the use of works. Its construction is not only related to the development ofemerging industries, but also plays a significant role in promoting progress in enriching culture.As a product of legal transplantation, China’s collective management of copyright is unsoundwhile facing new challenges in the Internet Era. Western countries’ legislation is more advanced.The section1summarizes the history, the conception and the function of the collectivemanagement of copyright. It is found that the Internet Era has caused a shock to the system. Thesection2analyzes the present situation of China’s collective management of copyright in theInternet Era. It is found that there are some problems in existing system. The section3comparesthe western countries’ legislation on the collective management of copyright. This part arguesthat a number of their valuable experiences are worth emulating. The section4provides somesuggestion to improve China’s existing system. This part argues that China should promote moremarket competition, establish the mechanism of the extended collective license and disputesettlement and reinforce the supervision mechanism.
