The scale of China’s Internet has become diversified. Terminals to access the Internethave become more and more. From the computer to the phone, and even now the Internetset-top boxes, are changing our lives. When watching video via the Internet set-top boxes,copyright infringement issues show up. Traditional TV programming is protected by"broadcast rights". What is the difference between it and Internet-based "InformationNetwork Transmission Right"? Which part will Tort Liability of Internet set-top boxmanufacturers fall into? What kind of copyright issues will show up? This paper willanalyze intellectual property law issues related to this video communication platform.Based on the introduction of relevant legislation status at home and abroad, confirm itsimputation principles and laws applicable, propose some recommendations to thelegislation in China and Lay a foundation for regular industry standards. Then providesome practical advice for copyright protection of Internet set-top boxes to achieve awin-win between copyright holders and terminal manufacturers.This paper is divided into five chapters. The first chapter includes the backgroundand significance of the research, review of researches, thesis research framework andmethods; the second chapter introduces the background of triple play to enhance reality ofthis research. Describe the definition of the Internet set-top box to provide backgroundknowledge. Outline the development of the Internet set-top boxes at home and abroad; thethird chapter does some analysis of law articles related to internet set-top boxes from theperspective of China’s Tort Liability Act; the forth chapter does some analysis of Internetset-top boxes copyright infringement with the theory of foreign including indirectinfringement theory and the Sony rule in US and the EU e-commerce directive; the fifthchapter concludes and make some recommendations for Internet set-top box industry fromseveral macro and micro perspectives, including improvement of laws, regulations andindustry standards, awareness of intellectual property rights and Internet set-top boxbusiness model.
